Some recent legal opinion is suggesting website terms and conditions could be unfair / unreasonable if they are too long and complex. With legals written by lawyers (who like arguing it seems), is there 'best practice' to refer to with there being much legal opinion (and argument) out there?

Some recent legal opinion is suggesting website terms and conditions could be unfair / unreasonable if they are too long and complex. With legals written by lawyers (who like arguing it seems), is there 'best practice' to refer to with there being much legal opinion (and argument) out there?
