    I have a list of email addresses from people who have signed up to receive tailored news notifications from my site.  When this system was set up several years ago (before my time), it was decided not to ask for any other permissions.  People simply select criteria, enter their email address, and click submit.

    We’d now like to use these addresses to send these people some marketing emails about our other products.  The email will obviously be from us and no third parties involved.

    Are we allowed to do this, or will it be a problem that we didn’t ask if we could send them information about ‘other products and services offered by us’ at the time they signed up?  The content of the emails will be very tailored and related to the news they receive, but there’s no mistaking it will be different.  Are there clear rules about this or is it a grey area?

    Any advice would be much appreciated!

    Technically its always good practice to ONLY send emails specifically related to the content they gave you permission to send and if your database contains personal email addresses that is particularly pertinent. However (and this was correct the last time I checked), UK laws state that whilst its unlawful to send unsolicited email to personal email addresses, emailing business email addresses is not, as it was considered that there could be some benefit in them receiving your emails.

    So, if its a B2B list I wouldn't see any problem in emailing them initially, but ensure your emails have an unsubscribe facility - that works!
