    Hello

After reading an interesting blog entry by Wordpress (http://tinyurl.com/2up4u9), we were inspired to investigate the cost of hosting one of our products in the US. Not surprisingly, the cost is far lower. We have been warned, however, that there may be data privacy issues and even ownership implications. Does anyone know if this is the case, and if there are any other possible issues we should look into?

    Thanks,

    Benno

    hi, Benno, how are you?

There are some data protection issues & it's essential to let customers know what you're doing in your privacy policy. Here's the relevant section from Last Minute:

"For any of the above purposes we may send your information internationally including to countries outside the EEA. Some of these jurisdictions offer differing levels of protection of personal information, not all of which may be as high as the UK. Beginning 1 June 2002, the personal information that you submit to us through the lastminute.com site will be collected, stored and processed at our third party service provider’s data centre in the United States. The United States has data protection laws that are different and/or less stringent than those in the UK. We will, however, ensure that your personal information is kept confidential and secure, and that the appropriate technical and organisational measures, to prevent unlawful or accidental destruction, accidental loss, unauthorised disclosure or access or other unlawful forms of processing, are implemented."

It's worth chatting to your legal person about this as they'll no doubt have experience of this & know what else you need to do.

As for other issues, there are two small ones I can think of:

    1. Speed of data transfer (only really an issue if you're sending a lot & you're on a slower server/link. try & test this first though - maybe browse some heavier sites hosted at the location you're looking at? Here's an older e-consultancy thread talking about this)
    2. Appearing in Google's Pages From The UK (there are also several threads on this here at e-consultancy)

    Hope that helps,

    daniel

    Hi Daniel

Many thanks for this - really helpful. That Lastminute seem to do it is encouraging, but I shall speak to our lawyer.
