Owner at Engine House Designs

I have a question regarding a situatio that recently came to light. I independantly consulted for a local company to develop a new portal site from an already established site. However, as I was nearing the completion of project, the owner of the company informed me that I would not be paid for the hourly time but instead for money generated by the site. I then told the owner that I would cease work on the site. My question is the following: Since I built a .com site - who owns it? He didn't pay for the site and I came up with the name, currently pay all expenses on the site and created all content including how the page would look and read. Also - is he legally bound by the cost of my time to the site even though no *formal* documents were presented and signed (aside from e-mail communication). Alot of lessons were learned from this project. This isn't the first time I did independant work for a company but the first time I didn't receive payment.
