The end of Instagram? New TOS go into effect Saturday

Instagram became a worldwide cultural phenomenon, mainly by being first to market with a cool idea: a photo sharing app with built in filters and a social platform for sharing.

Now its days may be numbered as the Facebook acquisition and new terms of service make it extremely uncool to the digitally hip.

We used a Twtpoll to ask how many of you will bail on the service after the changes go into effect Saturday. It was a very limited sample size, but the results are still interesting.

Personally I don't think it's any great shock or cause for outcry, but I do think it may be indicative of a deeper problem within the marketing and advertising industries: underestimating our customers...

Can terms of service turn you into a criminal?

If you live in the United States, a warning: you may want to read the terms of service of the websites you use a little more carefully. That's because a government prosecutor in New Jersey is pursuing criminal charges against the operators of a company that used an automated process to purchase event tickets on Ticketmaster.com for resale.

The charges are being brought under the Computer Fraud and Abuse Act (CFAA), which was passed in 1986 with the purpose of cracking down on the unauthorized accessing of computers (read: hacking). In U.S. v. Lowson, the prosecutor seeks to extend the CFAA to cover the violation of the Ticketmaster.com terms of service, which forbids individuals and companies from accessing the website in an automated fashion.

Facebook needs common sense, not democracy

Last week I wrote about Facebook's latest privacy flub which involved a change to the Facebook terms of service that didn't go over too well with Facebook users and the media.

In response to this, Facebook's CEO Mark Zuckerberg issued his standard apology. But that apparently wasn't enough.

Facebook makes a huge privacy flub - again

Facebook is on top of the world. Its continued growth is nothing short of amazing and it now has over 175m members worldwide. It's adding 600,000 each day.

Of course, Facebook has yet to turn its popularity into the type of revenue it needs to thrive long-term but if there's one thing that could bring Facebook down, it's not revenue. It's privacy.
